OUR PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties regarding the accuracy, reliability, or completeness of content
Warranties that our services will be uninterrupted, timely, secure, or error-free
Warranties regarding the results that may be obtained from use of our services

3.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PETRALIGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to, use of, or inability to use our services
Any conduct or content of any third party on our platform
Any content obtained from our platform
Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for any claims arising from or related to our services shall not exceed the amount you have paid to us, if any, in the twelve months preceding the claim.

3.3 Educational Nature and Career Disclaimers

Our courses and content are designed for educational and informational purposes only. We make no representations or warranties regarding career outcomes, job placements, salary increases, or professional advancement resulting from participation in our courses. Your career success depends on numerous factors beyond our control, including your personal effort, skills, experience, market conditions, and individual circumstances. We are not responsible for any employment decisions, career moves, or financial outcomes resulting from your use of our platform or participation in our courses.

3.4 Exclusion of Consequential Damages

In no event shall Petralign be liable for any loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary loss arising out of the use of or inability to use our services, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

4.3 User Submissions

By submitting content, feedback, suggestions, or other information to us, you grant Petralign a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. You represent and warrant that you own or have the necessary rights to submit such content and that it does not violate any third-party rights or applicable laws.

4.4 Copyright Infringement Claims

We respect intellectual property rights and expect our users to do the same. If you believe that any content on our platform infringes your copyright, please contact us with a detailed notice including: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief that the use is unauthorized, and a statement of accuracy under penalty of perjury.

5. Legal Information and Dispute Resolution

5.1 Governing Law

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding between you and Petralign shall be brought exclusively in the courts located in New Delhi, India, and you irrevocably consent to the jurisdiction of such courts.

5.2 Dispute Resolution Process

In the event of any dispute, controversy, or claim arising out of or relating to these Terms and Conditions or your use of our services, you agree to first attempt to resolve the matter informally by contacting us directly. We are committed to working with you in good faith to reach a mutually acceptable resolution.

If we are unable to resolve the dispute informally within 30 days, either party may pursue formal legal proceedings in accordance with the governing law and jurisdiction provisions stated above.

5.3 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and Petralign agree to waive any right to have any dispute resolved through class action, class arbitration, or any other representative proceeding.

5.4 Limitation Period

Any cause of action or claim you may have arising out of or relating to these Terms and Conditions or our services must be commenced within one year after the claim or cause of action arises, or such claim or cause of action shall be permanently barred, notwithstanding any statute of limitations or other law to the contrary.

6. Force Majeure

Petralign shall not be liable for any failure or delay in performance of our obligations under these Terms and Conditions if such failure or delay is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. During any such period of delay or failure to perform, our obligations shall be suspended, and we shall not be liable for any damages arising from such suspension.

7. Severability and Entire Agreement

7.1 Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent. If modification is not possible, the invalid provision shall be severed from these Terms and Conditions, and the remaining provisions shall remain in full force and effect.

7.2 Entire Agreement

These Terms and Conditions, together with our Privacy Policy, Cookie Policy, and Terms of Service, constitute the entire agreement between you and Petralign regarding your use of our platform and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

Our failure to enforce any right or provision of these Terms and Conditions will not be deemed a waiver of such right or provision. No waiver by us of any term or condition shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any waiver must be in writing and signed by an authorized representative of Petralign to be effective.

You may not assign, transfer, or delegate these Terms and Conditions or your rights and obligations hereunder without our prior written consent. We may assign, transfer, or delegate these Terms and Conditions and our rights and obligations without restriction. Any attempted assignment or transfer in violation of this section shall be null and void.

We reserve the right to modify, amend, or update these Terms and Conditions at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this document.
